Elliott May is able to assume the conduct of matters that range from the relatively straight forward, to those that are more complex and involve liquidators, receivers, priority disputes, claims of unconscionability, mortgages over part shares, marshalling disputes, cross-claims and the like. We are also regularly asked to take over enforcement matters which other solicitors have commenced but have been unable to progress due to the complexity of the matter or having used deficient documentation when setting the loan in the first place.
Timely Enforcement
At Elliott May we understand that the most successful strategy to recover funds under a defaulting mortgage is to ensure that all avenues of recovery are pursued against all debtors (mortgagors, borrowers, guarantors and chargors) as quickly and as proactively as possible. This often involves pursuing all parties until the default is properly rectified or the debt fully discharged.
